By accessing or using the Website, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use the Website.

1. Marketing Communications and Use of Submitted Information

Any information you submit to www.eternaschool.com, including personal details and contact numbers, may be used by Eterna Education Srl to respond to your enquiry and, where you have provided your consent or where we have a legitimate interest in doing so, to send you follow-up communications, promotional material, and information about our programmes and services by phone, SMS, or email.

In accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Italian Data Protection Code (D.Lgs. 196/2003, as amended by D.Lgs. 101/2018), such communications are sent only on the basis of your consent or a valid legitimate interest, and you may withdraw your consent or object to marketing communications at any time, free of charge, by using the unsubscribe link in any email, or by contacting info@eternaschool.com. Marketing calls will not be made to numbers registered with the Italian Registro Pubblico delle Opposizioni (Public Opposition Register) unless you have given specific, separate consent to Eterna to be contacted despite such registration.

2. Accuracy of Submitted Contact Information

If contact details of any individual are submitted to the Website by a third party, or are submitted inaccurately, Eterna Education Srl shall not be liable for any resulting claims from the affected individual. Any such individual may request that their personal details be removed from our records at any time by exercising their right to erasure under Article 17 GDPR, by writing to info@eternaschool.com.

Your access to and use of the Website is governed solely by these Terms. You may not use the Website for any purpose that is unlawful or prohibited by these Terms, by Italian law, or by European Union law.

Your continued use of the Website following the publication of any amendment constitutes your acceptance of the revised Terms. Where these Terms form part of a student enrolment contract, any change affecting your rights as a consumer will additionally be communicated to enrolled students directly, in accordance with the Refund Policy and applicable consumer protection law.

The Website may include informational links to external websites managed and maintained by third parties. The inclusion of such links does not imply endorsement of, or affiliation with, those websites. Eterna Education Srl is not responsible for the content, accuracy, or availability of any linked third-party website.

Any third party wishing to link to the Website must first contact Eterna Education Srl and obtain prior written consent before establishing such a link.

8. Intellectual Property and Copyright

You agree to indemnify and hold harmless Eterna Education Srl, and their staff, directors, and employees from and against any liability, legal fees, penalties, damages, costs, and other expenses arising out of or in connection with any claim or proceeding brought against Eterna Education Srl as a result of your breach of these Terms or your unlawful use of the Website. This clause does not limit or exclude any liability that cannot be limited or excluded under Italian or EU consumer protection law.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Italian law and, where applicable, European Union law.

Where you are acting as a consumer (consumatore) under the Italian Consumer Code (D.Lgs. 206/2005), any dispute arising from or relating to these Terms or your enrolment shall be subject to the mandatory jurisdiction of the court of your place of residence or domicile in Italy, as required by Article 33, paragraph 2, letter (u) of the Consumer Code, which cannot be waived or altered by contract to your disadvantage.

For all other disputes not involving a consumer, exclusive jurisdiction shall lie with the Court of Rome (Foro di Roma).

In accordance with EU Regulation No. 524/2013, consumers resident in the European Union may also submit a complaint through the European Online Dispute Resolution (ODR) platform, without prejudice to their right to use the School's internal Complaints Policy and Procedure or Appeals Policy and Procedure first.
